Please read these terms carefully before purchasing our flat fee MLS listing service.
These Terms and Conditions ("Terms") govern your use of this website and the purchase of flat fee MLS listing services from Peak Trust Realty LLC ("we," "us," or "our"). By completing a purchase, you agree to be bound by these Terms.
For a one-time flat fee of $118, Peak Trust Realty LLC will submit your residential property listing to the Multiple Listing Service (MLS) through MyStateMLS. This causes your listing to syndicate to Zillow, Realtor.com, Redfin, and 150+ additional real estate websites.
The flat fee MLS listing service includes:
This is a limited-scope MLS entry service. The following are not included unless separately agreed upon in writing:
You are selling your home as a For Sale By Owner (FSBO) with MLS exposure. You are responsible for responding to buyer inquiries, scheduling showings, negotiating offers, and managing the closing process — with your own attorney or closing agent.
You may offer a buyer's agent commission in your MLS listing. Any amount you specify is voluntary and solely at your discretion. We do not require or recommend any specific commission amount. Failure to offer a commission does not affect the MLS listing itself.
You warrant that all information you submit — including property description, square footage, features, photos, and price — is accurate and does not violate any applicable laws or MLS rules. You agree to indemnify Peak Trust Realty LLC for any claims arising from inaccurate or misleading information you provide.
We make no representation or warranty that listing your property on the MLS will result in a sale. Market conditions, pricing, property condition, and numerous other factors outside our control affect sale outcomes.
Payment is collected securely via Stripe at the time of order. The $118 fee is due in full before the listing process begins. Refer to our Refund Policy for refund eligibility.
To the maximum extent permitted by law, Peak Trust Realty LLC's liability for any claim arising from the flat fee listing service is limited to the amount you paid ($118). We are not liable for indirect, incidental, or consequential damages including lost profits or lost sale proceeds.
These Terms are governed by the laws of the State of Florida. Any dispute arising from these Terms or the service shall be resolved in Hillsborough County, Florida.
We reserve the right to update these Terms at any time. The version in effect at the time of your purchase governs your transaction.
